Trust Attorney Serving Sunnyvale
Coordinated Trust Planning for Your Family, Backed by Experience Since 1983
At Gilfix & La Poll Associates LLP, we help Sunnyvale families create trusts that address more than the transfer of property after death. A complete plan can identify who manages assets during incapacity, when beneficiaries receive property, and how the trust works with wills, powers of attorney, beneficiary designations, and property ownership.
California real estate, investment accounts, business interests, blended-family concerns, minor beneficiaries, and special-needs planning can add layers to these decisions. We develop personalized strategies that connect the trust’s terms to the assets and family circumstances it’s intended to address.

California Trust Guidance for Sunnyvale Families
We serve Sunnyvale from our Palo Alto base and have practiced estate planning, elder law, special-needs planning, and tax planning since 1983. Sunnyvale trust matters are governed primarily by California law. If a petition or dispute requires court involvement, the matter may proceed through the Superior Court of California, County of Santa Clara.
Our advice accounts for the relationship among trust documents, California property rules, beneficiary rights, trustee duties, and court procedures. We tailor each plan to the family rather than treating a trust as a standalone form.
Our trust-planning approach includes:
- Personalized Planning: We shape the trust around your family relationships, assets, intended beneficiaries, and long-term goals.
- Multigenerational Perspective: We consider how a plan may affect parents, children, grandchildren, and future generations.
- Integrated Guidance: Our practice brings together estate, tax, asset-protection, elder-law, and special-needs planning.
Peace of Mind Program: Ongoing Support & Communication
Our proprietary Peace of Mind (“POM”) Program maintains ongoing communication after clients complete their plans. This relationship allows us to learn about changes in their circumstances and update trust plans when appropriate. Read what clients have shared about working with a trust attorney serving Sunnyvale.
Marriage, divorce, births, deaths, incapacity, new property, changing business interests, or a beneficiary’s changing needs may call for a review. Through regular reviews and updates, the POM Program helps keep your trust aligned with your circumstances and changes in applicable law.
Trust Structures for Different Planning Goals
The right trust depends on the control you want to retain, the needs of your beneficiaries, your tax objectives, and the timing of future distributions. Michael Gilfix is a Certified Legal Specialist in Estate Planning, Trust and Probate Law through the State Bar of California.
Revocable Living Trusts
A revocable living trust generally allows the person creating it to retain control and make changes during life. It can also name a successor trustee to manage trust property during incapacity or after death. Assets properly transferred to the trust may pass without a standard probate administration, although the trust still requires administration.
Irrevocable Trusts
An irrevocable trust generally limits the creator’s ability to change its terms or recover transferred assets. These arrangements may be considered for particular tax, asset-protection, charitable, or family-planning objectives. Because the legal and administrative consequences differ from those of a revocable trust, the structure should be evaluated in the context of the entire estate plan.
Family Protection Trusts
Our services include Family Protection Trusts for families seeking structured management and distribution provisions. We examine who should serve as trustee, which beneficiaries the trust should support, and what standards should govern access to trust property.
Special-Needs Trusts
A special-needs trust is designed to hold and manage assets for a person with a disability while accounting for needs-based public benefits. Our firm was among the early California practices to develop planning programs for families with special needs and has been nationally recognized for this work. We help families evaluate special needs trusts within a broader plan for care, inheritance, and long-term management.
Tax-Oriented & Charitable Trusts
Some estates require coordination among trusts, lifetime gifts, charitable objectives, and estate and gift tax planning. We assess these arrangements alongside investment assets, business interests, real property, and the client’s intended legacy rather than addressing tax provisions in isolation.
Trust Administration & Successor Trustee Duties
Trust administration begins when a trustee must carry out an existing trust’s instructions, often after the settlor dies or becomes unable to manage the assets. A successor trustee may need to accept the appointment, identify and value trust property, notify beneficiaries and heirs, address debts and taxes, maintain records, and distribute assets under the trust’s terms.
A trustee generally has fiduciary duties, which are legal obligations to act in the interests required by the trust and California law. These duties can include protecting trust property, avoiding conflicts of interest, keeping appropriate accounts, providing required information, and treating beneficiaries according to the governing document.
We assist with trust administration and probate as part of our estate-planning and elder-law practice. We help trustees understand the document, organize the required work, communicate with beneficiaries, and identify questions that require tax, valuation, financial, or court input.
When Court Involvement May Be Necessary
A trustee or beneficiary may need court guidance when trust language requires interpretation, a trustee must be appointed or removed, an accounting is disputed, or a proposed modification requires approval. The Santa Clara County Superior Court may also hear trust contests and petitions concerning the internal affairs of a trust. We assist with trust contests and other trust-related litigation when disagreements can’t be resolved through administration alone.
Our Process for Creating or Updating a Trust
When you decide to create or update a trust, we begin with a detailed conversation about your family, assets, and long-term goals. We then explain how California law and court procedures in Santa Clara County interact with your wishes and help you weigh options for trustees, distribution standards, and protections for vulnerable beneficiaries.
A trust-planning engagement may include:
- Reviewing Your Circumstances: We discuss family relationships, existing documents, property ownership, business interests, and beneficiary needs.
- Defining Trust Goals: We identify who should manage assets during incapacity and how property should be managed and distributed after death.
- Selecting Fiduciaries: We help you consider trustees, successor trustees, and other decision-makers named in the plan.
- Preparing Documents: We draft the trust and coordinate it with wills, powers of attorney, and related estate-planning documents.
- Coordinating Trust Funding: Trust funding means transferring or aligning assets with the trust so it can operate as intended.
- Planning Future Reviews: We identify life, property, and family changes that may call for an update.
As your plan takes shape, we can coordinate with your financial advisor, tax professional, and other trusted partners so the trust works with your overall financial picture. This may involve retirement accounts, insurance policies, real property, investment assets, and ownership interests in a business. We consider how the plan will affect parents, children, grandchildren, and future generations.
Frequently Asked Questions
Can I Amend or End a California Trust?
A revocable trust can generally be amended or revoked by the person who created it while that person has capacity, subject to the trust’s stated procedures. Changing or ending an irrevocable trust is more restricted and may require beneficiary consent, trustee involvement, or court approval. The available approach depends on the document, the proposed change, and California law.
What If a Trustee Won’t Provide an Accounting?
A beneficiary may request information or an accounting when California law or the trust requires the trustee to provide it. If the trustee doesn’t respond, the beneficiary may consider a court petition seeking an accounting, instructions, or other relief. The appropriate step depends on the trust terms, the beneficiary’s status, and the trustee’s conduct.
What Happens to an Asset Left Outside the Trust?
An asset that wasn’t transferred to the trust may require probate or another transfer procedure after the owner’s death. In some situations, a petition may ask the court to confirm that property belongs to the trust. The result depends on title, beneficiary designations, estate-planning documents, and evidence of the deceased owner’s intent.
